1. About these terms and who we are

#RockstarMoment (the “Campaign”) is a collaboration between FMOF and Fantemo and is owned and operated by Fantemo, Inc. (“we”, “us”, “our”), a Delaware corporation with its principal place of business in Los Angeles, California.

These terms apply to every submission made through myrockstarmoment.com, fmof.fantemo.com/rockstar-moment, through any other submission page operated for the Campaign, and to content submitted using the hashtag #RockstarMoment where we contact you and you confirm participation.

By submitting content or taking part, you agree to these terms. If you do not agree, please do not submit.

A short summary of the key points appears on the submission page. That summary is for convenience only; these full terms govern.

2. Eligibility

• You must be 18 years of age or older to submit content or take part.
• No purchase or payment of any kind is necessary to participate, and no payment will be requested from you at any time.
• Participation is void where prohibited by applicable law.
• We may verify eligibility at any time and may decline or remove any submission that does not meet these requirements.

3. What we are asking for

We invite people to share a short video showing a personal “Rockstar Moment”. Selected submissions may be included in FMOF’s “Rockstar” music video and related FMOF and Campaign content, including social media and short-form video.

The current Campaign is not a contest, sweepstakes, lottery or prize promotion. There is no prize, no entry fee and no element of chance. Selection is made at our discretion on editorial grounds alone. Any future brand-funded prize or giveaway will have separate published terms that apply to that promotion.

4. Your submission and your warranties

By submitting, you confirm that:

• The content is yours to share, and you own it or hold all rights and permissions necessary to grant the licence in section 5
• Every identifiable person appearing or heard in your content has given their consent to appear and to the uses described in these terms, and each of them is 18 or over
• The content does not infringe any third party's intellectual property, privacy, publicity or other rights
• The content does not include music, footage, artwork, logos or trademarks belonging to anyone else unless you hold the rights to them
• The content is not unlawful, defamatory, obscene, sexually explicit, hateful, harassing, discriminatory or threatening, and does not promote violence, self-harm or illegal activity
• The information you give us, including your name and contact details, is accurate and your own

You are solely responsible for the content you submit and for obtaining any consents it requires.

5. Rights you grant us

By submitting and checking the consent box on the form, you grant us a non-exclusive, worldwide, royalty-free, sub-licensable licence to store, review, download, reproduce, edit, crop, caption, translate, adapt, combine with music and other material, publish and distribute your content across FMOF and Campaign platforms and channels, and in related promotional material, in any media now known or later developed.

You keep ownership of your content. Nothing in these terms transfers copyright to us.

You may withdraw this licence for future uses at any time by emailing support@fantemo.com. We will stop making new use of your content within 30 days of receiving your request. Content already published, distributed or incorporated into a finished Campaign work before that date may remain in use, and we are not required to recall, edit or remove it.

No fee, royalty or other payment is or will be due to you for any use permitted under these terms.

We will use reasonable efforts to credit participants where practical, but credit is not guaranteed and its absence is not a breach of these terms. To the extent permitted by law, you waive any moral rights in your content in connection with the uses described above.

6. Prohibited content, and content we report

We may reject, remove, delete or decline to use any submission at our sole discretion, at any time, with or without explanation.

Content that we consider unlawful, or that suggests a risk of serious harm to any person, may be retained and reported to law enforcement or other relevant authorities, together with the submission details and contact information associated with it. We may do this without notice to you where we consider notice inappropriate or unlawful.

This includes, without limitation, content that appears to depict or facilitate violence or threats of violence, abuse or exploitation of a child, sexual exploitation, human trafficking, terrorism, or a credible risk of harm to the submitter or another person.

We are not obliged to monitor submissions, and a decision not to act on one submission does not create an obligation to act on any other.

7. Wellbeing

Some people will share personal or difficult stories. We are not a support service. If you or someone you know needs help, please contact a qualified professional or an appropriate local support service. We may decline to publish content where we consider publication inappropriate or potentially harmful, including out of concern for the person in it.

8. No guarantee

Submitting does not guarantee that your content will be selected, featured, published or included in any Campaign material. We make no promise as to timing, prominence, duration of use, or that any use will occur at all.

9. Privacy and data protection

Who is responsible. Fantemo, Inc. is responsible for personal information collected through the Campaign.

What we collect. Your name, email address, the link or content you submit, any information contained within it, and your correspondence with us. Contact details are held in our email platform for Campaign updates.

Why we collect it. To review and administer submissions, to contact you about your submission and related opportunities, to send Campaign updates where you have opted in, to produce Campaign content, and to comply with legal obligations.

Marketing. You can unsubscribe from Campaign emails at any time using the link in any email, or by emailing support@fantemo.com.

How long we keep it. We keep submission records for 24 months after the Campaign ends, except where longer retention is required for legal, rights-management or reporting purposes, or where your content remains in published Campaign material.

Who we share it with. Service providers who help operate the Campaign, including hosting, form, email and storage providers; production partners working on Campaign content; and others where required by law. We do not sell your personal information.

California residents. Under the California Consumer Privacy Act as amended by the CPRA, you have the right to know what personal information we hold, to request deletion or correction, to opt out of certain data practices, and not to be discriminated against for exercising those rights. We do not sell or share personal information as those terms are defined by the CCPA.

Participants outside the United States. Your information will be transferred to and processed in the United States. Where the EU GDPR or UK GDPR applies to you, our lawful basis for processing is your consent, and you may withdraw that consent, request access, correction, deletion or portability of your data, or complain to your local supervisory authority. Withdrawal does not affect processing carried out before withdrawal.

10. Liability

The Campaign and this site are provided on an “as is” basis. To the fullest extent permitted by law, we exclude all warranties and are not liable for indirect, incidental, special, consequential or punitive damages, or for loss of data, content, opportunity or profit, arising from participation in the Campaign.

Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited.

You agree to indemnify us against claims, losses and reasonable costs arising from content you submit or from your breach of these terms, including claims brought by people appearing in your content and claims of intellectual property infringement.

11. Changes and suspension

We may update these terms. The version in force at the time of your submission applies to that submission. Material changes will be posted on this page with an updated date.

We may suspend, modify or end the Campaign at any time without liability.

12. Governing law

These terms are governed by the laws of the State of California, without regard to its conflict of laws principles. The state and federal courts located in Los Angeles County, California have exclusive jurisdiction over any dispute arising from them, and you consent to that jurisdiction and venue.

13. General

If any provision of these terms is found unenforceable, the remainder stays in force. Our failure to enforce a provision is not a waiver of it. These terms are the entire agreement between us regarding the Campaign, other than any separate release you sign.
